Thank you for using Shopper’s Interface. By accessing our website, mobile application, or any associated services (collectively referred to as “Shopper’s Interface” or “the Platform”), you agree to comply with these Terms of Use (“TOU”). If you do not agree to these terms, you are not authorized to use the Platform.
If you are using Shopper’s Interface on behalf of a business or organization, you confirm that you have the authority to accept these TOU on its behalf.
We reserve the right to modify these TOU at any time. Your continued use of the Platform after changes are posted constitutes acceptance of the revised TOU.
Our Privacy Policy, Prohibited Content Policy, and other policies referenced within this TOU are incorporated by reference and form part of this agreement.

1. LICENSE TO USE SHOPPER’S INTERFACE
Subject to your compliance with these TOU, we grant you a limited, non-exclusive, revocable, and non-transferable license to use Shopper’s Interface for buying and selling goods and services in Kenya.
You may not:
• Copy, modify, distribute, sell, or lease any part of the Platform.
• Create derivative works or attempt to reverse engineer our software.
• Use automated tools (e.g., bots, scrapers) to access our services.
• Misuse the Platform or violate Kenyan laws.
By posting content on Shopper’s Interface, you grant us a non-exclusive, worldwide, royalty-free license to use, display, distribute, and create derivative works from your content for the purpose of operating and marketing the Platform.

2. ACCEPTABLE USE POLICY
When using Shopper’s Interface, you agree not to:
• Post false, misleading, or fraudulent advertisements.
• Engage in unlawful activities, including fraud, money laundering, or sale of prohibited items.
• Impersonate others or misrepresent your affiliation with a business.
• Use the Platform for spam, unsolicited promotions, or phishing.
• Violate Kenya’s Data Protection Act, 2019 by misusing user information.
• Engage in hate speech, harassment, or posting offensive material.
We reserve the right to remove content, suspend accounts, or take legal action against users who violate these terms.

3. PAYMENT AND TRANSACTIONS
• Shopper’s Interface does not directly process payments. Users must agree on payment terms independently.
• We encourage safe transactions and recommend using M-Pesa or other secure payment methods.
• We are not responsible for disputes between buyers and sellers but may take action against fraudulent listings.

4. LIABILITY AND DISCLAIMER
• Shopper’s Interface provides a marketplace for users but does not verify the accuracy of listings. Transactions are at your own risk.
• We are not liable for losses resulting from fraudulent transactions, misrepresentation, or third-party actions.
• The Platform is provided “as is” without warranties regarding uninterrupted or error-free use.

5. TERMINATION AND ENFORCEMENT
We may suspend or terminate your account if you:
• Violate these TOU or applicable laws.
• Engage in fraudulent, abusive, or harmful conduct.
We also reserve the right to moderate content by removing or re-ranking listings at our discretion.

6. GOVERNING LAW AND DISPUTE RESOLUTION
These TOU are governed by the laws of Kenya. Any disputes shall first be resolved through negotiation. If unresolved, disputes may be referred to arbitration or a Kenyan court with appropriate jurisdiction.
